Remote Access Agreement
Certification and Acceptance
By clicking the “I Agree” button at the bottom of this page, I, (the customer) agree that I am of legal age and am the owner or the owner’s authorized agent of the computer or equipment for which services are sought from Smith Technical Resources, LLC. By clicking the link to launch the remote session, I will accept service from Smith Technical Resources, LLC and acknowledge that I have read and understand these terms and conditions and agree to all terms and conditions stated herein.
This Agreement constitutes the entire understanding and contract between the parties and supersedes any and all prior and contemporaneous, oral or written representations, communications, understandings and agreements between the parties with respect to the subject matter hereof, all of which representations, communications, understandings and agreements are hereby canceled to the extent they are not specifically merged herein. The parties acknowledge and agree that neither of the parties is entering into this Agreement on the basis of any representations or promises not expressly contained herein.
Authorization to Access your Computer
You acknowledge that by your use of Smith Technical Resource, LLC’s Online Remote Computer Repair Service you are authorizing Smith Technical Resources, LLC to access and control your computer for the purposes of computer diagnosis, service and repair. In connection with delivering the services, Smith Technical Resources, LLC may download and use software, gather system data, take remote control of your computer and access or modify your computer’s configuration settings. By accepting these terms, you hereby grant Smith Technical Resources, LLC the right to connect to your computer, download and use software on your computer to gather system data, repair your computer, take remote control of your computer and change the settings on your computer while performing the diagnostic & repair services. You agree that Smith Technical Resources, LLC has no responsibility or liability under any circumstance at any time for any loss or harm that may arise from or may be related to the services.
Backup All Data Prior to Service
During the course of a remote or onsite repair, customer personal data can possibly be lost and unrecoverable. You agree and understand that it is your (the customer’s) responsibility to maintain copies of ALL data on your computer, and to obtain and/or make such copies and/or archives to external media PRIOR to authorizing Smith Technical Resources, LLC to commence any remote services for you. Smith Technical Resources, LLC’s staff, partners or affiliates are not responsible for lost, missing, unrecoverable or damaged data that may occur during a repair/service session. By acceptance of this agreement and connection to Smith Technical Resources, LLC’s Online Remote Computer Repair Service you agree and affirm that you have made a backup copy, to an external archive, of any/all data on your computer’s hard drive that you wish to retain.
You have requested remote access repair service which includes repair, evaluation, diagnostics, upgrade, installation, setup, virus & malicious software removal, backup or other services on your computer from Smith Technical Resources, LLC. Note that at the conclusion of a remote access repair service session that is terminated by either the customer or Smith Technical Resources, LLC, the data connection and all access between Smith Technical Resources, LLC’s Remote Access Repair Service and the customer computer is completely severed and Smith Technical Resources, LLC personnel can no longer access the customer’s computer without the explicit authorization of the customer to make a new connection.
It is not our standard practice to access personal customer data. Any customer data temporarily archived by Smith Technical Resources, LLC, either by customer’s separate service request or in the course of a Remote Access Repair Service, will not be shared in any manner or with any other entity or person, in accordance with applicable law regarding confidentiality of customer data.
While we use reasonable security measures to deliver our remote access repair services, you understand and acknowledge that no data transmission over the Internet can be guaranteed to be 100% secure and in any event we cannot guarantee that any personal information You submit to us will be free from unauthorized intrusion.
Fees and Charges
Smith Technical Resources, LLC will attempt to evaluate, diagnose and repair/upgrade or service your computer via remote access for an applicable fee. Remote access repair services generally require a working broadband internet access connection to the computer that is in need of repair, but can also include voice telephone consultation services. In some instances, a successful repair is not possible due to unforeseen problems with your computer’s hardware, software or configuration. Under these circumstances, Smith Technical Resources, LLC is not liable for incomplete repairs, but will forego any charges, or issue a full refund for any charges made, for that specific unsuccessful remote diagnosis and repair attempt.
Payment for the Smith Technical Resources, LLC services rendered is due upon completion of the repair by cash payment, or credit card (Master Card, Visa, Discover card, American Express or Pay Pal) processed through secure merchant services provided by PayPal.
Unless otherwise agreed in writing, Smith Technical Resources, LLC is not liable for, and you agree to hold Smith Technical Resources, LLC harmless, from any and all damages, costs, and expenses incurred as the result of any loss, defect or damage to any software or data residing or recorded in your computer, whether incurred during the course of Smith Technical Resources, LLC’s services or otherwise. If service involves transferring information or installing software, you represent that you have the legal right to use/copy the information and to use the software and agree to the terms of the software license, and you authorize Smith Technical Resources, LLC to transfer the information and accept such terms on your behalf in performing the service.
By accepting your order for remote access repair services on your computer, Smith Technical Resources, LLC warrants that service will be performed to the best of our ability. Smith Technical Resources, LLC does not warrant that the service provided by our personnel will be performed at any particular speed, bandwidth or data throughput rate. All remote access repair services, with the exception of virus, malware, spyware, crimeware, ransomware and all other malicious software removals and cleanups, are warranted for a period of thirty (30) days at the discretion of Smith Technical Resources, LLC. Virus and malware eradication will be done to the best of our ability using the most up-to date techniques and professional software removal tools available. There are no implied or other warranties made by Smith Technical Resources, LLC with respect to repairs or services. Smith Technical Resources, LLC’s total liability to you for any and all damages whatsoever is limited to the amounts paid to Smith Technical Resources, LLC for the services rendered.
